MAP Policy

We at HornBlasters strive to protect our reputation for providing customers with world class customer service and high value products, in addition to enhancing the HornBlasters brand image and our competitiveness in the marketplace. Our efforts to achieve the level of business we aspire, has lead us to implement a policy of minimum advertised price standards for all HornBlasters products. This Minimum Advertised Pricing Policy (MAP Policy) will apply to distributors, retailers, dealers, including catalogs and internet retailers, who resell HornBlasters products to end users.

HornBlasters holds each of our Resellers with the upmost respect to distribute our products and support our customers. The MAP Policy is adopted for our Resellers to protect them, ourselves, and our customers by giving everyone an equal opportunity to sell and buy our products. There are no exceptions to the policy and it will be uniformly enforced.

This MAP Policy shall work under the following guidelines:

1.  HornBlasters, Inc. will, periodically, publish a Schedule of Manufacturer’s Suggested Retail Prices (MSRP) via email or some form of communication, which may be amended or adjusted by HornBlasters at any given time at our discretion. The MSRP will identify the date from when the schedule will be effective, the catalog of products, and the MSRP for those products. Advertisement of products identified in the MSRP Schedule less than the MSRP will be in a violation of our MAP Policy.

2. Our MAP Policy applies to all advertisements of HornBlasters products listed on the MSRP Schedule in and all media. This policy is not applicable to any in-store advertising that is displayed only in the store and not distributed to any customer(s).

3. If pricing is displayed, and mark downs, strike-through or any other alterations of the MSRP that is paired with a discount price less than MSRP is prohibited.

4. Our MAP Policy applies to only advertised prices and does not apply to the price at which HornBlasters products are sold or offered for sale to an individual within the Resellers retail location. Resellers have the right to sell these products at any prices they choose under these circumstances.

5. The MAP Policy does not establish a maximum for advertised prices. All Resellers have the right to offer HornBlasters products at any price above MSRP.

6. Pricing listed on an internet site is considered ‘advertising prices’ and must adhere to our MAP Policy. Once the pricing is associated with an intent to purchase (added to shopping cart), the price becomes the selling price and is bound by our MAP Policy. Also, any discounts that are applied at checkout to an entire order based on the customers purchasing history does not violate the MAP Policy.

7. Internet auctions may not advertise or have reserves less than MSRP.

8. Our MAP Policy is solely within HornBlasters discretion and authority acting through the staff here at HornBlasters. No sales representative of HornBlasters has any authority to modify or grant exceptions to this MAP Policy. Any action by a sales representative not authorized to modify or grant exception to this MAP Policy is unauthorized and invalid. Questions about MAP Policy should be emailed to sales@hornblasters.com. The MAP Policy manager shall be solely responsible for determining whether a violation of the policy has occurred, communicating decisions to Resellers regarding the policy and receiving any communications regarding sanctions imposed under this MAP Policy. Any action taken by HornBlasters under this MAP Policy shall be without liability to HornBlasters.

9. At the discretion of HornBlasters, we may choose to offer special promotions on certain products. We reserve the right to modify or suspend our MAP Policy in whole or partially by notifying all Resellers of the nature and duration of the change. These changes will apply equally to all Resellers, and HornBlasters reserves the right to adjust the MSRP of any and all products at our discretion.

10. Repeated and intentional failure to abide by MAP Policy will result in sanctions across the board imposed by HornBlasters. The level and severity of the sanctions will be determined by HornBlasters and may include indefinite termination of dealership or distributorship. HornBlasters does not intend nor will we do business with Resellers who degrade the image of HornBlasters and our products. HornBlasters also reserves the right to not provide prior notice or issue warnings before taking action under MAP Policy.

11. The terms of this MAP Policy are confidential and should not be discussed with any other parties. This MAP Policy has been established and created by HornBlasters to ensure the longevity of HornBlasters as a top producer of high performance, high quality products and to protect the reputation and the brand of its name and products. This MAP Policy is designed to avoid intra-brand conflict and to ensure that Resellers have the incentive to live up to the HornBlasters brand and service that we provide our customers.
